Man charged with stealing food from spa and stealing gasoline from construction site at gunpoint | Guam News

A man who was allegedly caught stealing food from an Upper Tumon spa was also involved in a terrorism and theft complaint reported about two weeks earlier.

Andrew Ray Toves, 30, was sitting on the floor of the home spa when police arrived at the scene at around 7am on Wednesday for a reported disturbance.

“Police met with a male subject … who stated he caught an individual attempting to steal at the facility. “Police were escorted to the rear kitchen area where police observed another male subject sitting on the floor while a female subject stood at the back door frantically yelling at police,” according to a judge’s complaint filed in Superior Court of Guam .

According to police, the woman identified as the spa’s owner had spent the night at her establishment and the man police spoke with had arrived in the morning to take out the trash, with the back door open.

“The defendant entered the spa and began searching the kitchen area. (The man) caught the defendant with a canned food. “(The man) and the victim then held the defendant until police arrived,” the complaint states.

Police searched Toves’ person and discovered a hard object in his right front pocket.

“When the defendant was asked about it, he stated that he didn’t know and that the police could take it away. Police pulled the item out and discovered it was a clear glass pipe with a bulbous end. “Police discovered a white crystallized substance at the end of the bulb,” the complaint states.

The substance was tested at the scene, which resulted in a presumptive positive result for methamphetamine.

Ten days earlier, on September 15, police filed a separate complaint with Blics Heavy Construction, where Toves was previously employed.

“Victim 2 works for Blics. Victim 2 saw a former employee at the scene who was verbally identified as Andrew Ray Toves (defendant). Victim 2 went to the defendant and asked him why he was there. “The defendant stated he needed gas,” the lawsuit states.

The victim told police that he told Toves, “No,” and to leave.

The victim also reported to police that he saw a Blics hose and gas canister in the back of Toves’ “black Ford Ranger.” But when the victim asked Toves to put the items back, Toves allegedly pulled out a gun.

“The defendant then ran to the driver’s side of the truck and grabbed a black handgun. The defendant then pointed the gun at Victim 2 and told Victim 2, “Move or I will shoot you,” the complaint states.

Fearing for his life, the victim told police that he left the construction site and made his way to the nearest police station.

As a result of the two incidents, police arrested Toves, who was charged Thursday in Superior Court of Guam with the following offenses: burglary as a second-degree felony; Possession of a Schedule II Controlled Substance as a Third Degree Felony; Terrorizing as a third-degree felony; reckless conduct as a misdemeanor; attempted theft of property as a petty crime; and criminal offense as a petty crime.

Toves was booked into the correctional facility with bail set at $5,000.
