Uttar Pradesh Bar Council passes resolution to transfer Supreme Court judge for ‘insulting’ lawyers

On Sunday, the Uttar Pradesh Bar Association unanimously passed a resolution to transfer justice Sangeeta Chandra by The Allahabad High Court to another Supreme Court.

The resolution also states that Justice Chandra should not be given any judicial duties until she is transferred.

The Council also supported a letter from General Secretary of Oudh Bar Association, Advocate Manoj Kumar Dwivediaddressed to the Chief Justice of the Supreme Court seeking transfer of Justice Chandra.

This letter was written following an order passed by the Justice Chandra-led division bench on September 27 recommending criminal contempt proceedings against senior public prosecutor Satish Chandra Mishra.

In his letter to the Chief Justice, General Secretary Oudh Bar Association said Justice Chandra had violated the dignity of her office by passing an order initiating criminal contempt of court proceedings against Senior Advocate SC Mishra.

In its resolution, the State Bar Council also mentioned that many of its members had informed it that Justice Chandra, while serving not only in the Lucknow Bench but also in the Allahabad High Court, had insulted the lawyers.

It is to be noted that a criminal mistreatment case was recommended against senior public prosecutor SC Mishra after the bench found that the chief advocate had “scandalized” the court and “weakened its dignity” by casting aspersions on the conduct of court proceedings expressed and made personal accusations of malice.
