Co-convict of AAP MP Prakash Jarwal moves Delhi High Court

New Delhi [India]September 30 (ANI): Another co-convict of Aam Aadmi Party (AAP) MLA Prakash Jarwal in the Dr. Suicide case. Rajender Singh was referred to the Delhi High Court. The matter was listed for hearing on October 18.

In this case, AAP MPs Prakash Jarwal, Kapil Nagar and Harish Jarwal were convicted on February 28.

During today’s hearing in the trial court, counsel for convict Kapil Nagar sought an adjournment on the ground that Nagar had moved to the Supreme Court.

Thereafter, special judge Kaveri Baweja posted the matter for hearing on October 21.

Justice Amit Mahajan subpoenaed the court record on September 27.

Earlier, on August 30, Justice Amit Mahajan had quashed the conviction of Harish Jarwal on the ground that an agreement had been reached with the complainant on August 10.

Harish Jarwal had challenged the February 28 verdict of the Rouse Avenue Court.

He was convicted of the offense under Section 506 (criminal intimidation) of the IPC and the same applies to the person so intimidated.

Senior advocate Ravi Sood, along with Saurabh Agarwal, submitted for the petitioner that the petitioner was only charged and convicted for the offense under Section 506, Part I of the Indian Penal Code, 1860 (“IPC”).

After hearing the submissions of the counsel and the defendant, the Supreme Court had allowed the petition and set aside the judgment dated February 28 to the extent of conviction of the plaintiff, subject to payment of a total cost of Rs.30,000 by the plaintiff within eight weeks from today to the Delhi Police Welfare Society Submit.

The Supreme Court had said that since the state machinery had been set in motion and the settlement had come at such a late stage, justice would be served if the plaintiff was tried.

In this case, an FIR was registered at Neb Sarai police station in 2020. (ANI)
