CBI charges Sanjay Roy in rape and murder of trainee doctor at RG Kar Medical College – ThePrint – PTIFeed

New Delhi, Oct 7 (PTI) Sanjay Roy, a volunteer of the Kolkata Police, raped and killed the trainee doctor in the seminar room of RG Kar Medical College and Hospital on August 9, the CBI said in its first chargesheet filed on Monday in the high-profile case, ruling out “gang rape.”

In the charge sheet, filed in a Sealdah court 54 days after the CBI took over the investigation, the agency said that Roy committed the crime alone and that it has so far found no evidence to support the allegations of gang rape and the Involvement of other people and officials could substantiate knowledge of the developments said.

The agency told the court that it had left open the investigation into other aspects of the crime, they said.

An appendix containing statements from prosecution witnesses was appended to the report.

Local police arrested Roy the next day of the crime, August 10, based on the CCTV footage and his inability to explain his behavior at the time of the crime.

The CBI relied heavily on the CCTV footage that showed Roy entering the seminar room around 4 am on August 9, they said. The recordings showed that he left the room after 30 minutes, it was said.

The DNA samples taken from his nails also pointed to his role in the gruesome crime, they said.

The body of the aspiring doctor was found on August 9th at 9:30 a.m. by her colleague, who went to look for her before the visit.

The Tala police station was informed about the “body of an unconscious woman” and its team reached the spot around 10.30 am. Her autopsy revealed multiple internal and external injuries to her body.

The CBI has booked Roy under Bharatiya Nyaya Sanhita, Sections 64 and 66 relating to rape and 103(1) relating to murder.

Section 66 of the BNS prescribes a penalty for causing the death of a woman during rape to be a minimum of 20 years imprisonment or life imprisonment or death penalty. According to Section 103 Paragraph 1, the punishment is the death penalty or life imprisonment.

The CBI, which took over the investigation on August 14 following a Calcutta High Court order, also took over Roy’s custody and conducted a detailed interrogation followed by a lie detector test.

Roy had protested his innocence during questioning and said that when he entered the room he found the doctor unconscious. He couldn’t explain why he didn’t inform the police.

Roy had refused to consent to the drug analysis following which the CBI could not proceed with the investigation.

The CBI has also arrested senior officer of Tala police station Abhijit Mondal and former principal of medical college Sandip Ghosh in the case. Ghosh is also facing another CBI case for alleged corruption.

The murder of the junior doctor sparked protests from practicing doctors across the country demanding better security for them.
